—  Buyer & seller advice

The legal bit.
Without the legal headache.

Buying or selling a home in Scotland comes with a legal process.

Offers. Conveyancing. Title deeds. Missives.

If your eyes are already glazing over, don’t worry.

You don’t need to become a property lawyer to move home. You just need the right solicitor looking after the legal side and a good estate agent keeping everything else moving.

That’s where the right team makes all the difference.

Why do I need a solicitor?

In Scotland, a solicitor handles the legal side of buying or selling your property. That includes things such as submitting or accepting formal offers, checking the property’s title and progressing the legal contract between buyer and seller.

What on earth are missives?

You’ll hear this word quite a lot when buying or selling in Scotland.

Put simply, the missives are the formal letters exchanged between the buyer’s and seller’s solicitors which form the contract for the sale.

Once they’re concluded, the agreement becomes legally binding.

Your solicitor will guide you through exactly what that means for your particular transaction.

Frequently asked questions

No. The buyer and seller each need their own solicitor to avoid a conflict of interest, as both sides are represented separately in the missives.

For a typical Scottish sale, from acceptance of an offer to the date of entry is often around 6 to 8 weeks, though it varies with chains, mortgages and the date both parties agree.

It’s the date you get the keys and the sale completes, the Scottish equivalent of completion day. It’s agreed as part of the missives.

We can introduce you to trusted local firms we’ve worked with for years, but the choice is always yours.
